The firm possesses considerable expertise in areas ranging from the evaluation of the right to take issues, planning construction and route selection, good faith negotiation of easements and right-of-way and title examination to the acquisition of easements and rights-of-way through use of the administrative and judicial process.

Lawyers in the firm have been involved in, among others, the following condemnation matters:

  • Have represented common carriers and public utilities in condemnation proceedings in connection with the construction of cross-country pipelines throughout East Texas and from the Gulf Coast.
  • Have represented counties in condemnation proceedings in connection with the construction of roadways and pipelines.
  • Successful defense of pipeline companies on right to take and good faith negotiation issues including representing the common carrier client in one of the leading right-to-take cases. “Vardeman v. Mustang Pipeline Co.,” 51 S.W. 3d 308 (Tex.App.-Tyler 2001, pet denied).
  • Obtaining Temporary Restraining Orders for entry to property.
